Veteran Sues McDonald's for $10 Million After Alleged Attack

An Iraqi War veteran is suing McDonald's for $10 million after alleging he was beaten for bringing his service dog into the restaurant.

Retired Army Capt. Luis Montalvan, an Iraqi War veteran who earned two Bronze Stars, filed a lawsuit claiming he was assaulted by employees of a Brooklyn franchise, the New York Post reports.

Montalvan claims workers at the Brooklyn McDonald's franchise hit him with the lids to plastic garbage cans when he tried to enter with his golden retriever, named Tuesday. He suffers from post-traumatic stress disorder and traumatic brain injury, and said the beating left him with back and neck injuries, the Post reports.

"We take these matters seriously," a spokeswoman for McDonald's told Slashfood. "We investigate all allegations to gather the facts, and where necessary, take action consistent with our policies.

"Our policy is to permit service animals to accompany customers with disabilities, in our restaurants. We comply with all applicable laws, including the American Disabilities Act."


Montalvan told the Post he was told to leave the Brooklyn McDonald's franchise last December when he entered with the dog. "Employees started yelling, 'No dogs!' and 'Get out!' " he said.

After Montalvan sent a letter to the company to complain, McDonald's put stickers on the franchise's doors saying service dogs were allowed inside.

However, when he returned on Jan. 30 to take photos of the stickers, he alleges two men in McDonald's uniforms came toward him with plastic garbage can lids and beat him for two minutes. The franchise, in the Sunset Park neighborhood of Brooklyn, did not respond for comment.

And Mickey D's should pay up big time, the fanchise closed and new management taken over! Our veterans have enough to deal with, and animal haters are some of the worst scum on earth. Hopefully a good attorney is there ready to do business for this brave soldier!

MCD'S SHOULD PAY OUT MORE THAN 10 MIL, THEY SHOULD HAVE TO SHOULDER THAT MAN'S MEDICAL, FINANCIAL, AND ALL OTHER BILLS HE HAS FOR THE REST OF HIS LIFE. THAT WOULD MAKE OTHERS THINK TWICE BEFORE ABUSING OUR COUNTRY'S SERVICE MEN AND WOMEN. THE STAFF RESPONSIBLE FOR THE BEATING SHOULD ALSO BE FIRED AND BLACKBALLED FROM WORKING AT ANY SERVICE RELATED BUSINESS' UNTIL THEY HAVE TO PAY TO ATTEND CLASSES THAT TEACH HOW TO ASSIST ALL DISABLED PERSONS.

That being said why didnt he contact the manager of the store, the police, etc. But now he talks to a lawyer. The truth will come out when he goes to court.

That lady that got burned was at an automated drive thru coffee machine that McD's had set up alongside the regular drive thru lane. The machine shot hot coffee at her into the car and on her lap. She deserved millions!!!!

Get a job, obviously if you can sit in front of a computer playing the sick guy, you can work at a desk. As far as this guy is concerned, I think this guy is making most of it up and most likely doesn't have his dog proerly marked, to show it is actually a helping dog and just not some mutt tethered to his chair.

If they won anything they had friends to pick up there prizes. So if it is going on in one store then it is going on in all of there stores. And on top of that she would bring home bags full of food for her family and not pay for it. Contacted the main office about this and they did nothing about it. If you steal from your job you would get fired, but not at mcdonalds. So good luck playing a game that you can't win, and truth be known most of the winners are probably friends of employees. And yes I witnessed all of this, thats why I don't spend my money there anymore.

You may be a Marine, but you're an idiot. Your dog is a trained combat soldier, while Capt. Montalvan's dog is a trained Service Dog. The difference, you ask? Like the difference between a Navy Seal and a Trauma Nurse. Service Dogs go through at least a year of training to be calm and quiet while in their harnesses. I'm sure your dog has his own type of "service" collar (as most police and military dogs do) and reacts totally different when "off leash."

BTW. I'm a Vietnam vet who handled dogs over there, and I and my family have trained three Handicap Service Dogs over the years, so I'm well versed in what I say.

So, before you go spouting your bravado again, think about what you are about to say, then think again before you type it so everyone can see you're a bunch of Hooya.

People better get used to brave men and women who served this country and were injured having live assistance. I PERSONALLY HOPE THIS VET SUES THE CRAP OUT OF MCDONALDS AND WINS. UNDOUBTEDLY RAY KROC'S VISION OF MCDONALDS HAS BEEN TRASHED. AND FOR THE RECORD "ROOKIE AND I NOW EACH AT HARDEES" Those morons who beat this man are very lucky becasue usually in a situation where the dog determinds (they are exceptionally well trained) that the master is at high risk they will take the offending party apart. Rookie would give his life for me and I for him without question or reservation. The one thing for sure is that you would know you had been in one hell of a fight.thanks for your service Captain.
