McDonald's Sued Over Gold Earring in Sandwich

A Chicago man has filed a lawsuit against McDonald's Corporation after he says he swallowed a gold earring in his sandwich.

The man purchased the sandwich on Aug. 11 from the McDonald's at Chicago's Navy Pier, according to the suit filed on Wednesday in the circuit court of Cook County, Ill.

The plaintiff, Boguslaw Nedza, claims after he ate the sandwich "the earring became lodged in his throat and stomach and efforts to remove it by emergency personnel were unsuccessful." Nedza is now suing McDonald's for the injuries he sustained from ingesting the jewelry.

Among the charges McDonald's faces is failing to "prepare and serve food in a reasonable safe condition," and failing to warn Nedza that his food contained "a gold earring with a sharp needle and clasp rending it unfit for consumption."

When Slashfood asked about the lawsuit, McDonald's Corporation issued the following statement: "We are not aware of this matter, nor have we been notified about a lawsuit. We take all inquiries very seriously. However, at this time, it would be inappropriate to comment or further speculate without more information."

10-01-2009 @11:42AM Jimmie said... Even people who don't have teeth chew thier food. It's hard to believe that he did not feel this object somehow before swallowing. My mother-in-law finds bone chips and all kinds of tiny particles and doesn't have a tooth in her mouth. Sounds fishy to me.
