A judge has tossed out a plagiarism and copyright infringement lawsuit alleging Jerry Seinfeld's wife stole her cookbook idea from another author.
Federal Court Judge Laura Taylor Swain dismissed the suit by author Missy Chase Lapine alleging the ideas and recipes for Jessica Seinfeld's "Deceptively Delicious: Simple Secrets to Get Your Kids Eating Good Food" came from her "The Sneaky Chef: Simple Strategies for Hiding Healthy Foods in Kids' Favorite Meals," the New York Daily News reports.
"This is a complete vindication of Jessica's creativity," Orin Snyder, a lawyer for Jessica Seinfeld, told the Daily News.
The judge said the only similarity between the books was their goal of hiding healthy food inside kids' meals, the Associated Press reports.
Swain declined to rule on defamation claims against Jerry Seinfeld, saying they should be filed in state court. Last year, the funnyman appeared on "The Late Show with David Letterman" and joked that people with three names like James Earl Ray and Mark David Chapman turn out to be assassins, the AP said.
Lapine's lawyer told the AP that claim and one against HarperCollins -- the publisher of the Seinfeld book -- "are still very much alive."

9-12-2009 @10:01PM Red said... It's amazing what money can do and well known people also by going on tv and talking about it. The original author doesn't have this advantage or the money. The judge's decision to dismiss the lawsuit is wrong.

9-12-2009 @11:19PM speckldowl said... This is really kinda sad. I have both books and like them each for different reasons. I don't see them as competing but sharing the market. Not to mention my Mom did the same kinds of things when I was a kid - she just never wrote a cookbook about it. That's how I became interested in them in the first place - I wanted some new recipes besides the ones I grew up on. I know it sucks when someone else does the same thing, but it doesn't always mean they stole your idea. I don't know what really happened, so I can't say who's right or wrong, but it would be nice if they could work things out peaceably.

Perhaps you are jealous of her? My husband is in the top 1% of income earners and I cook every meal, other than our Friday night date. I'll bet most mothers can't say the same. Before you stereotype me, I have four kids, do the housework, pay the bills, work part time and volunteer as a soccer coach three days per week! My husband works about 70 hours per week...so he's not helping me. You should lay off the people who are paying 90% + of all taxes, we are paying the bills for the rest of you!

Then feel that you have been wronged, when in reality, the simple truth is that you shared the same ideas as someone else? When my youngest was potty training, about 15 yrs. ago, I wrote a story about poo poo. Poo playing baseball and boating in a wonderful place called the sewer! I drew my own pictures and created my own crude homemade book. I used it for all of my children and it worked very well. I loaned it to friends who loved it. Several years later while in the bookstore, I saw a childrens' book with nearly the exact same storyline! I was sure they must have copied me....that maybe somehow they heard about my story. After I really thought about it, however, I realized that it was just another mom with the same ideas and imagination as me. Why do you automatically assume that because Jessica is rich she can't possibly have an imagination of her own, or even know how to cook?

I may not know much about the law on "copyrights" etc, but, I thought when it comes to cookbooks it is not the contents and/or the recipes, but, the presentation that one needs to worry about. After all, who is to say who came up with the idea first before either book was published. This concerns me somewhat. I myself have been compiling recipes for my cookbook I hope to finish by the end of the year. I have been working on it for several years. Many of my recipes has its' roots going back to Italy and Germany from the mid 1840's to the turn or the 20th century. Imagine the millions of immigrants who came over during those days with the exact or similar recipes. I have found a few recipes printed in a cookbook back in the 1920's that has recipes my German descendants brought with them from Germany back in the 1840's. Perhaps I am talking through my hat, but, I had the impression that it is the presentation of the cookbook that is copyrightable, not so much with the recipes.
