I'm sure you've seen those commercials for Dannon's Activia yogurt, the ones that say that the yogurt contains special ingredients that help with digestion and the immune system. Now those claims are being challenged by a lawsuit.
The lawsuit says that the ad lie and that Dannon's own research doesn't even back up the medical claims. The yogurt costs 30% more than regular yogurts and the lawsuit says that this is unwarranted because the advertising is deceptive. The suit is looking for damages for anyone who bought any of the Activia brands, and they also want Dannon to stop the ads and run a new "corrective ad campaign."
Other brands aren't mentioned in the lawsuit because they don't make the same claims.

I dont buy Activia, it is so very expensive. But, I have a RD next door to my office and I asked her about these claims, and she totally agrees. They do not say what their basis for compairason is. They do not say what state their control group was in before they started this research. But at the same time, people should do their own research on what they put into their mouths. I am not sure what I think about seeing damages though...

We buy it because my toddler loves it and prefers it over other brands. And the smaller serving sizes are just right for him.

I see that you’re writing about a lawsuit against Dannon and I wanted to share Dannon's position.
All of Dannon’s claims for Activia and DanActive are completely supported by peer-reviewed science and are in accordance with all laws and regulations. Dannon’s advertising is and will continue to be absolutely truthful, and Dannon will vigorously challenge this lawsuit.
If you'd like to hear both sides of the story, please check out a statement we released in response to this lawsuit on our website at http://www.dannon.com/about_press.aspx

Hi Michael,
I followed the link you supplied but it only shows Press Releases through 2007, nothing for 2008. I am interested in seeing your response to this issue. Thank you.

Deceptive advertising...oh my who's ever heard of such a thing. Haha, sorry, I'm being snide. But come on, ads always stretch the truth about their product being so tasty/healthy/organic/long-lasting, etd etd. Example? I'm preeetty sure no matter how many vitamins you put in coke, it's still crappy for you.

This boils down to legal fees. The class members will likely get a coupon for some free yogurt but the lawyers will be compensated handsomely.
As to the yogurt, sure it's good for you but is it better for you than 'regular' yogurt?

better then stoneyfield, or kefir, which have more probiotics and have been around for a long time, i don't think so. Yogurt has been around for centuries- there is nothing new here, just a marketing ploy- if you understand good nutrition than you would had been eating yogurt years ago- read labels- mwhy don't people read labels- there is nothing magic in activia- just a cute little container

Being as Dannon is owned by Coke, that they lie about anything shouldn't come as a shock. I try to buy as few products from Coke, Inc. due to their record of human rights violations.

The FDA doesn't care about decption and false advertising by food companies because according to the FDA "it is not a priority, we are under staffed and it is not a safety issue".
The vanilla flavor is not natural in Dannon yogurts either, but they label it as if it is natural and as it is conforms to the 'Standard of Identity for Vanilla'.
Dannon and many of the other yogurt and ice cream companies do the same thing and the FDA is asleep at the switch and does nothing.

William: you asked to see Dannon's full statement about this and here it is:
Dannon Refutes Class Action Lawsuit Alleging Misleading Claims
January 24, 2008
White Plains, N.Y.
The Dannon Company, Inc. today provided the response below to a class-action lawsuit filed yesterday in Los Angeles, CA.
Dannon is aware of the lawsuit and we are reviewing it. Dannon proudly stands by the claims of its products and the clinical studies which support them. All of Dannon’s claims for Activia and DanActive are completely supported by peer-reviewed science and are in accordance with all laws and regulations. Dannon’s advertising has always been and will continue to be absolutely truthful, and Dannon will vigorously challenge this lawsuit.
Dannon strongly disagrees with the allegations in the lawsuit. The filed complaint does not contain any support for the broad generalizations made in the lawsuit. The one publication cited in the lawsuit does not disprove Dannon’s scientific substantiation for its proven product benefits. Indeed, the report cited in the lawsuit, published by the American Academy of Microbiology, does not even reference any Dannon products.
Dannon makes all scientific studies about its products available to the public following the established method of peer-review and publication. Dannon regularly consults with leading independent experts in the field of probiotics about the science behind all of its probiotic claims.
The scientifically substantiated benefits of Dannon’s products are confirmed not only by the scientific journals that have reviewed and published the findings - which are made available on the company’s web sites for any and all to read - but also by the millions of highly satisfied consumers who enjoy Dannon’s products.
For a more detailed scientific summary about Dannon products and the scientific evidence to support claims, please visit www.activia.us.com and www.danactive.com.
